In Ontario, there can be two parts to every motor vehicle accident. There are claims against drivers, called Tort claims, and also claims against insurance companies called Accident Benefits claims.
Tort Claims
Tort claims are designed to compensate you and your loved ones for your pain and suffering, loss of income, loss of ability to earn income, extra housekeeping expenses, home maintenance expenses, health care and attendant care expenses. There are also provisions regarding claims for various family members. There are conditions, however, about how and when you can make a tort claim.

Accident Benefits
Accident Benefits are available to anyone involved in a motor vehicle accident regardless of who caused the accident. These benefits are occasionally referred to as no-fault benefits.
If you or a family member have been injured in a motor vehicle accident, or a fatality has occurred, the following Accident Benefits may be claimed from your own insurance company.
The benefits are:
- Income Replacement Benefits/Caregiver Benefits /Non Earner Benefits
- Medical and rehabilitation benefits( available for physiotherapy and other treatments)
- Attendant care benefits (to pay for a personal attendant)
- Housekeeping and home maintenance benefits
- Death and funeral expenses
- Replacement of damaged clothing and eyeglasses
- Travel and other expense
